1. Your relationship with YO2ZING

1.1 Your use of the website www.yo2zing.com (the “Website”) is subject to the terms of this agreement between You and YO2ZING (“Terms”).

1.2 The Terms and Conditions constitute a legally binding agreement between You and YO2ZING regarding Your use of the Website. It is important that You read them carefully. Terms apply to all users.

2. Accepting the Terms

2.1 In order to use the Website, You must firstly agree to the Terms. You may not use the Website if You do not accept the Terms.

2.2 You can accept the Terms by simply using the Service. You understand and agree that YO2ZING will treat Your use of the Website as acceptance of the Terms from that point onwards.

2.3 You may not use the Website and may not accept the Terms if (a) You are not of legal age to form a binding contract with YO2ZING, or (b) You are a person who is either barred or otherwise legally prohibited from receiving or using the Website under the laws of the country in which You are resident or from which You access or use the Website.

2.4 You should print off or save a local copy of the Terms for Your records.

3. Changes to the Terms

3.1 YO2ZING reserves the right to make changes the Terms from time to time. Therefore You must look at the Terms regularly to check for such changes. The modified version of the Terms (the "Modified Terms") will be posted at https://www.yo2zing.com/privacy-policy If You do not agree to the Modified Terms You must stop using the Website. Your continued use of the Website after the date the Modified Terms are posted will constitute Your acceptance of the Modified Terms.

4. YO2ZING account

4.1 In order to access some features of the Website, You will have to create a YO2ZING account (“Account”). When creating Your Account, You must provide accurate and complete information. It is important that You must keep Your Account password secure and confidential.

4.2 You are solely responsible for the accuracy, relevance, completeness and compliance with applicable law of the registration information and notifying YO2ZING of changes to such information.. Assuming You provide false details or in case we have serious doubts about the information provided by You being false, inaccurate, incurrent and incomplete, we reserves the right to suspend or to cancel Your registration and refuse any and all current or future use of our Technology; or to request personal details such as copy of Your passport and actual proof of place of residence.

4.3 Upon completion of the registration process, You receive username and password to access the Account.

4.4 You are solely responsible for maintaining the confidentiality of the username and the password, as well as for any action-taking place under Your account. You agree to notify us immediately in any case of any unauthorized access (without Your permission) to Account using Your username and password, or any breach of security.

4.5 In case the password to Account was lost or compromised by a third party for any reason, You may generate a new password to Your account by connecting to Your account manager or through a message sent to Your e-mail address by website administration.

4.6 Termination of Your account includes automatic deletion of Your password and all related information, files and content associated with or inside Your Account. We shall not be required to store Your data such as registration form information, statistics, reports etc. following the Agreement termination. After removal of the Account You lose the right to access the Website.

4.7 You agree that You will be solely responsible (to YO2ZING, and to others) for all activity that occurs under Your Account.

5. General restrictions on use

5.1 YO2ZING hereby grants You permission to access and use the Website, subject to the following express conditions, and You agree that Your failure to adhere to any of these conditions shall constitute a breach of these Terms on Your part:

a. You agree not to distribute any part of or parts of the Website without YO2ZING's prior written authorization;

b. You agree not to alter or modify any part of the Website;

c. You agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of the Service;

d. You agree not to use or launch any automated system (including, without limitation, any robot, spider or offline reader) that accesses the Service in a manner that sends more request messages to the YO2ZING servers in a given period of time than a human can reasonably produce in the same period by using a publicly available, standard (i.e. not modified) web browser;

e. You agree not to collect or harvest any personal data of any user of the Website or any Service (and agree that this shall be deemed to include YO2ZING account names);

f. You agree not to solicit, for commercial purposes, any users of the Website.

5.2 As part of this continuing innovation, You acknowledge and agree that YO2ZING may stop (permanently or temporarily) providing the Website (or any features within the Website) to You or to users generally at YO2ZING’s sole discretion, without prior notice to You.

5.3 You agree that You are solely responsible for (and that YO2ZING has no responsibility to You or to any third party for) any breach of Your obligations under the Terms and for the consequences (including any loss or damage which YO2ZING may suffer) of any such breach.

5.4 YO2ZING informs You that Website includes YouTube API Service. By using Website You accepting YouTube’s terms of service, located at: https://www.Youtube.com/t/terms, and also consenting to the collecting, using and storing Your personal information in accordance with Google's Privacy Policy, located at: http://www.google.com/policies/privacy. You have a right to withdraw the consent to the collecting, using and storing Your personal information at any time by visiting page at: https://security.google.com/settings/security/permissions.

6. YO2ZING Intellectual property on the Website

6.1 Texts, software, scripts, graphic images, photographs, sounds, music, video, audiovisual combinations, interactive features and other materials that You can view, receive or share using the Website (“Intellectual Property”) is either owned by or licensed to YO2ZING, and is subject to copyright, trade mark rights, and other intellectual property rights of YO2ZING or YO2ZING's licensors. Any third party trade or service marks present on Intellectual Property not uploaded or posted by You are trade or service marks of their respective owners. Such Intellectual Property may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of YO2ZING or, where applicable, YO2ZING's licensors. YO2ZING and its licensors reserve all rights not expressly granted in and to their Intellectual Property.

7. Links from YO2ZING

7.1 The Website may include hyperlinks to other web sites that are not owned or controlled by YO2ZING. YO2ZING has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.

7.2 You acknowledge and agree that YO2ZING is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such web sites or resources.

7.3 You acknowledge and agree that YO2ZING is not liable for any loss or damage which may be incurred by You as a result of the availability of those external sites or resources, or as a result of any reliance placed by You on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.

7.4 YOZING encourages You to be aware when You leave the Website and to read the terms and conditions and privacy policy of each other website that You visit.

8. Exclusion of Warranties

8.1 The Website is provided "as is" and YO2ZING makes no warranty or representation to You with respect to them.

8.2 In particular YO2ZING does not represent or warrant to You that:

a. Your use of the Website will meet Your requirements,

b. Your use of the Website will be uninterrupted, timely, secure or free from error,

c. any information obtained by You as a result of Your use of the Website will be accurate or reliable, and

d. that defects in the operation or functionality of any software provided to You as part of the Website will be corrected.

8.3 No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the Website except to the extent that they are expressly set out in the Terms.

9. Limitation of Liability

9.1 YO2ZING shall not be liable to You for:

a. any indirect or consequential losses which may be incurred by You. This shall include; (i) any loss of profit (whether incurred directly or indirectly); (ii) any loss of goodwill or business reputation; (iii) any loss of opportunity; or (iv) any loss of data suffered by You;

b. any loss or damage which may be incurred by You as a result of:

i. any reliance placed by You on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between You and any advertiser or sponsor whose advertising appears on the Website;

ii. any changes which YO2ZING may make to the Website, or for any permanent or temporary cessation in the provision of the Website (or any features within the Website);

iii. Your failure to provide YO2ZING with accurate account information;

iv. Your failure to keep Your password or YO2ZING account details secure and confidential.

9.2 The limitations on YO2ZING’s liability to You in paragraph 9.1 above shall apply whether or not YO2ZING has been advised of or should have been aware of the possibility of any such losses arising.

10. Privacy Policy

10.4.2 to grant You the full access to YO2ZING ’s technology and any other services;

10.4.3 to provide You with all features of the technological services of the Website.

10.5 You may request YO2ZING to update or delete Your Personal Information and/or to limit the processing of Personal Information provided. YO2ZING is handling the Your request within 2 (Two) months. In that context You understand and agree that:

10.5.1 updating, deleting and/or limitation the processing of Your Personal Information may cause loss of further use of Website in whole or in part;

10.5.2 YO2ZING is entitle to demand extra remuneration for handling unfounded and/or unreasonable Your requests or to deny handling such requests by sending written explanations to You.

10.6 If You provide us with a means of contacting You, YO2ZING may use such contact information to communicate with You. For example, YO2ZING may send You promotional offers on behalf of other businesses or communicate with You about Your use of the Website. 10.7 Please note that any video, image, or other content posted at the direction of users onto the Website becomes published content and is not considered Personal Information subject to this Privacy Policy.

Whenever You interact with the Website, we automatically receive and record information on our server logs from Your browser, including Your IP address, “cookie” information, and the page You requested.

11. General legal terms

11.1 The Terms constitute the legal agreement between You and YO2ZING and govern Your use of the Website.

11.2 You shall not directly or indirectly attempt to persuade partners, customers, employees, suppliers or consultants of YO2ZING for cooperation with the You, employment or acceptance of employment offers or other proposals from the You or third parties whose activities may compete or be contrary to the interests of YO2ZING.

11.3 You agree that YO2ZING may provide (but has no obligation to do it) You with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Website.

11.4 If any provision of the Agreement is held to be invalid and/or unenforceable by a competent court or regulatory body, such invalidity and/or unenforceability shall not affect the remaining provisions of the Agreement. We reserve the right to replace the invalid and/or unenforceable provisions by a provision that is valid and enforceable and which reflects to the extent possible our original intention or remove it in its entirety. The remaining provisions of the terms will nevertheless remain in full force and effect.

11.5 You acknowledge and agree that each member of the group of companies of which YO2ZING is a part shall be third party beneficiaries to the Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favour of) them. Other than this, no other person or company shall be a third party beneficiary of the Terms.

11.6 The Terms, and Your relationship with YO2ZING under the Terms, shall be governed by law.You agree that YO2ZING shall still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.
